1. General

"zoyaonline" (in Hebrew, Zoya Online) is the website (hereinafter the "Site") of "Zoya Fashion (2009) Ltd." C.P. 514232008 (hereinafter the Company) and/or its shareholders (hereinafter the Owner), which offers and sells fashion products, footwear and related accessories via the Internet, with payment and shipping methods that vary from time to time.

*** The provisions of these regulations will apply to all users or surfers of the site, and it and only it will constitute the legal relationship between the customer and the company.

*** The use of the feminine form is for convenience only, and everywhere in the regulations, the masculine form will also be referred to.

*** Use of the site and/or joining the site's customer club and/or purchasing through the site and/or subscribing to the site's newsletter is conditional on the member's and/or purchaser's consent to the terms of these regulations; and consent to receiving promotional mail in various media from time to time, as decided by the site's management.

*** The company reserves the right to change the website regulations from time to time, without any prior or special notice.

*** The company may offer promotions and discounts on the website that differ from the promotions and discounts offered to customers in the store, and it may also cancel or change them without any prior notice.

*** All products on the site in Hebrew, and intended for shipping within Israel, are priced in new shekels, they include VAT and do not include shipping fees (unless otherwise expressly stated by the site administrators).

*** All images, all data and all descriptions of the various products and the raw materials from which they are made are for illustrative purposes only.

*** Please note, the product images on the site may have changes in product colors between each user's screen/device, with a deviation of up to 10% from the original color. In the event of disagreements between the company and the customer, no refund will be given for shipments except according to the company's cancellation policy .

*** All sales through the website are conducted in accordance with the Consumer Protection Law 5741 – 1981, and its regulations, as applicable from time to time.

2. Purchase

A. You can purchase items from the site, subject to availability and inspection of their integrity; by credit card. By typing on the site or by phone: 054-4502609 (WhatsApp).

B. In every purchase process, you must ensure that the details (credit number, full name, telephone number, e-mail address) are provided/typed accurately. It should be noted that orders that contain inaccurate customer details may be canceled.

C. In any case where an order has not received final and absolute approval of the payment method, and in any case where the order is in the process of verifying approval of the payment method - the order may be canceled, without the obligation for prior notice from the site.

D. The site management uses its best efforts to ensure that all information displayed on the site is complete and correct, thus facilitating purchases through the site; however, it is clarified that items may appear that are no longer in stock, and there may be inaccuracies or deviations between the information displayed and the actual situation. In any case, the site will not be liable for any damages resulting from these errors or related to them in any way.

E. For the avoidance of doubt, it should be noted that sending an e-mail to the customer's address does not constitute final evidence of confirmation of receipt of the order; only what is recorded on the site's computers will constitute evidence of the order's fulfillment as aforesaid.

F. All purchasers on the site are entitled to cancel their purchase, subject to the cancellation policy written in the regulations, and subject to the state laws relating to the matter.

G. Shipping fees, if any, will be charged together with the first payment, in the case of an installment transaction.

H. If you selected the "self-pickup from the company's warehouses" option, you will receive a notification when your order is ready for pickup.

3. Shipping

A. After the order has been received by the site's computers, and the products in the order are in stock and found to be in good condition and suitable for shipment, and after the transaction has been approved by the payment method - a notification will be sent to the customer, along with the shipping details.

B. Shipments will be via Israel Post or a shipping company, and will be made according to their regulations and under their responsibility. The site will not be responsible for any delay and/or non-delivery caused by events beyond its absolute control.

C. We will try to deliver and send you the product within two to three days, but the commitment for product delivery times will be 1 – 14 business days (excluding Fridays and Saturdays, holiday eves and holidays).

D. Delivery areas are limited. If the delivery company or post office cannot reach the address you requested, we will try to contact you to find an alternative solution.

E. The shipping cost varies from time to time, and is 25 NIS for delivery by courier to your home or work.

F. All purchasers on the site undertake to inform the site, via email, telephone or via the “Contact Us” option, of any delay in the arrival of the shipment beyond the maximum delivery times. Purchasers who do not inform the site management of the non-arrival of the shipment will be barred from any claim in this regard.

The customer is required to verify the correctness of the order after receiving the order.

{That all items are in the order in the size and color ordered and that the products have indeed been inspected and are in good condition} and inform the company by contacting the website or customer service phone number immediately upon arrival of the shipment,

Purchasers who do not inform the site management of the incorrectness of the order within a reasonable time will be barred from any claim in this regard.

4. Return/Cancel Transaction

A. All purchasing activities on the site are subject to the Consumer Protection Law 5741 (1981), and its various regulations, as they may apply from time to time. (Click to view the regulations) Consumer Protection Law Concerning Transaction Cancellation )

B. All customers are entitled to return the goods purchased on the site, except for goods specified in the law as restrictions on their return; and receive a full refund for the product, minus a cancellation fee of 5% not to exceed 100 NIS, and provided that the payment method allows this.

The return will be made using the same payment method used for the purchase, to the extent possible (there will be no refunds for those paying with direct debit cards of any kind or with prepaid credit cards of any kind. Purchasers using these methods will be entitled to receive credit/rebate/voucher for purchases on the site).

C. The returned goods must be new and in their original packaging/form, without any defect, unused at all, and with the label attached to them still in place. Purchasers must ensure that the item that arrived is the item ordered, and that no error has been made that prevents maximum enjoyment of it (the model is correct, the color is correct, the size is correct, the texture and all additional features are appropriate), before they make their initial use; as the company allows the return of new products only!

D. The goods may be returned by any means you choose, provided that they arrive at the company's warehouses, or at the nearest post office, within 14 days at the latest. The buyer's cancellation of the transaction will be processed within 10 days from the date the goods were returned to the company's warehouses in accordance with the terms of these regulations.

E. The site reserves the right to cancel an order itself, in whole or in part, due to a lack of proper inventory, an error between what is displayed and what is actually available, or due to suspicion of inappropriate use of the site and/or not in accordance with these regulations.

F. The site will notify you of the cancellation of an accepted order by telephone or e-mail.

G. Purchasers on the site waive in advance any claim regarding any damage, whether direct or indirect, that may be caused to any of them or on their behalf due to use of the site and/or due to cancellation of an order by the site as stated in Section E.

H. L. Purchasers on the site have the right to cancel the transaction in accordance with the regulations of the Consumer Protection Law "Cancellation of a Transaction"
Consumer Protection Law

A consumer may cancel a transaction (which is not included in the exceptions as specified below) from the date of execution of the transaction until 14 days from the date of receipt of the property or from the date of receipt of a document including the details of the transaction, and if he is a veteran citizen, a new immigrant or a person with a disability (and the connection in the transaction included a conversation between the trader and the consumer) - within 4 months from the date of receipt of the property or receipt of the document including the details of the transaction, whichever is earlier. To the extent that the cancellation is not due to a defect, non-conformity or failure to deliver on time, we may charge a cancellation fee of 5% or NIS 100, whichever is lower.

When canceling a transaction that is not due to a defect, you must return the product to our warehouse at 4 Homa Street in Rishon Lezion between the hours of 09:00 - 17:00, Sunday - Thursday, or send them via One of the chain's branches (who is not a franchisee).

To the extent you have the right to cancel the transaction, you must send a cancellation notice in one of the following ways:

The cancellation notice must include your full name, telephone number, and order number (or invoice number). If the cancellation notice is given verbally, we may request additional identifying information.

We strive to deliver products without defects, however, if a defect is discovered, a discrepancy between the order and what was received, or the product is not delivered, you have the right to cancel the transaction and receive your money back, and we will not be charged cancellation fees or shipping fees.

5. Kosher and use approval

A. The user of this site hereby declares that he is over the age of 18, and is legally authorized to make purchases in distance trading; the user also declares that he has received the consent of the owner of the payment method to use it to purchase products on the site.

B. All content, texts, symbols, images, graphics, and all data found in the company and/or on the site, including methods and procedures, the list of products and the name given to them, the products themselves and their integration on the site – are intellectual property and the exclusive property of ZOYA and its owners.

C. Anyone who uses any of the symbols of the site and/or the company and/or the intellectual property of the site and/or the company, as detailed in Section B above, will be deemed to have infringed the company's copyright, even if a trademark has not yet been registered regarding the infringement, with all that this implies.

D. Anyone who performs actions that are likely to interfere with the proper operation of the site, or of the company (whether by providing false information, or in any other way) will be considered as having crossed the line and entered the company's offices in his actions, with all that this implies.

E. Anyone who copies and/or displays and/or saves and/or collects content from the site and/or permits another to do so, whether using software or any device, for a purpose other than that for which the site is intended, will be considered to be infringing the copyrights and intellectual property of the company, with all that this implies.

F. All users of the site hereby declare that they use it for the purpose for which it was intended (presentation and sale of clothing, footwear, fashion accessories and skincare products via the Internet) and in good faith.

*** Anyone who violates major section 5 above (hereinafter the section entitled “Kosher and Use Approval”), in whole or in part, or its sub-sections, will be subject to appropriate legal action, even if it is not proven that his actions caused any damage to the site and/or the company.

*** The user who does not comply with these regulations waives in advance any claim that his actions did not cause any damage to the site or the company.

6. Privacy and secure shopping

A. The website and the company do not store credit card information or any other payment method.

B. The company uses clearing companies, some of the largest in the Israeli economy, that operate according to strict security standards, and it does its best to protect customers' privacy and their credit card details.

C. When entering credit card details, advanced security measures come into effect, the sole purpose of which is to prevent the possibility of misuse of the information entered, all on an external, secure page and according to strict standards.

All information protected under the Privacy Protection Law, 5741 – 1981, which may contain details that would allow identification of any of the users of the site; including name, telephone number, addresses, ID numbers, etc.; will not be disclosed to anyone except the relevant information that will be disclosed to another body and/or entity in accordance with the policy detailed below:

Relevant information for the shipping company for the purpose of coordinating any shipment and/or for the purpose of inspecting any shipment.

Relevant information in the event that the company operating the website is required to do so by any court, and/or in the event that there is a dispute of a legal nature between the user and the company operating the website.

Information relevant to employees of the company that operates the site or to employees on its behalf who are employees of another company, related to the company that operates the site, and all of this to enable the proper operation of the site at all times.

The Company may use “cookies” with all that this implies.

7. Service after purchase or after use of goods purchased on the site

A. The site or the company that operates it are not responsible for any direct or indirect damage caused as a result of using the site, or the products sold through it, even if in good faith; including due to failure to deliver a product, late delivery, delivery of a product incorrectly, delivery of a defective product, delivery of an incomplete product; or for any other reason.

B. In any case, buyers are entitled to cancel the purchase, as stated in section 4 above.

C. Care should be taken to use products according to the manufacturer's and/or importer's instructions, as applicable (especially washing and drying), and it is recommended to wash knitwear and jeans separately the first two times, as there may be color transfer during washing.

D. The site also sells goods that are not manufactured or imported by the company, but are purchased for you from external suppliers.

E. The company does its best to provide you with a correct and high-quality product on time. In any case of a claim regarding any inherent defect in the goods and/or the operation of the site – please contact the site offices, via e-mail and/or telephone, and the site's customer service personnel will try to get back to you within 3 business days.

and. The limit of liability that the site will bear in the event of damage resulting from the use of the product and/or failure to deliver the product - will be up to the value of the product at the time of purchase. Beyond the consideration paid for the purchased product, the company will not bear any damage caused as a result of the use of the products , even if in good faith, and even if it is proven to have been caused as a result of using the product and/or browsing the site, in general; and in particular due to damage caused as a result of poor product quality, product breakdown, product failure over time, product deterioration in washing, color transfer from the product to another item (whether during wearing, friction or washing), degradation caused as a result of using the product, bodily harm caused as a result of using the product, other economic damage caused as a result of using the product or its failure to deliver it.
